This Privacy Policy applies to the website www.myqcompanion.com, the Q-Companion mobile application and any related platforms or services (collectively, the “Services”) controlled by Ålö Aktiebolag, Reg. No 556081-0482 (“Ålö,” “we”, “us” or “our”). BY USING THE WEBSITE OR MOBILE APPLICATION, YOU CONSENT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND TO OUR PROCESSING OF PERSONAL INFORMATION FOR THE PURPOSES STATED BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICES.

A. Information Collected

When you use the Services, we collect both personal information and non-personal information. The types of personal information we collect from you depends on the features you use on the Sites. Non-personal information does not identify you personally.

(1) Personal Information

When you register a user account on Ålö’s website or on Ålö’s mobile application you may provide certain personal details to Ålö (such as, but not limited to, your name and e-mail address), which may be deemed personal information under applicable law. Here are some examples of the types of personal information we may collect through the Services:

  • We may collect your e-mail address if you contact us with a question;
  • We may collect your name and e-mail address if you register for an account; and
  • We may collect information about the type of work performed, time consumed and equipment or tools used with the Ålö loader.

(2) Non-Personal Information

Non-personal information can be technical information that does not identify you personally. We note, however, that over time, non-personal information could become personal information through regulatory developments, technological advancements, or co-mingling with personal information. Here are some examples of the non-personal information that is collected via the Services:

  • Cookies, Web Beacons, and Similar Tracking Technologies - We may use certain kinds of technology such as cookies and web beacons or work with third party web analytic service providers to collect information about how you use the Services. Among other things, the use of cookies, web beacons, and similar tracking technologies enables us to improve our services by seeing which areas and features are most popular, to count the number of computers or mobile devices accessing our services, to personalize and improve your experience, to record your preferences, to allow you to visit our Services without re-entering your username and/or password, and to improve the performance of our advertising across the Internet. A cookie is a small amount of data which is sent to your browser from a website's computer and stored on your computer's hard drive or your mobile device. Most browsers automatically accept cookies as the default setting. You may be able to set your browser not to accept cookies, or to warn you when a cookie is being placed on your computer. Some of the cookies we use may be more persistent in nature, meaning they may not be deleted when your cookies are deleted. Please check your browser and browser settings to determine where these types of cookies are stored and whether and how they may be deleted. However, if you choose not to accept cookies, your ability to use our Services may be hindered. A web beacon is an electronic image, also called a "gif," that may be in the form of a "png" image, as well as iframe, script, input link, embed, object, and other tags to track usage. These web beacons may be used on our web pages to deliver cookies, count visits and compile statistics on usage and effectiveness of our Services.
  • Information regarding use of the loader – Some Ålö loaders have an integrated system where information regarding the use of the loader, such as the number of lifts and the average weight lifted, is stored automatically. This information may be digitally sent, uploaded, communicated or transmitted to the Services. Ålö may use this information for providing and managing the Services, statistical purposes, and developing the Services and Ålö products on a pseudonymized and/or anonymized basis.

Please note: from time to time, we may combine Personal Information with Non-Personal Information and when we do, for the purposes of this Privacy Policy, we will refer to the combined data as “Personal Information”.

B. Use of Information Collected via the Services

Ålö processes personal information and company information accordance with applicable law. This information may be processed for the following purposes:

  • Analysing the use of our Services;
  • Operating our Services;
  • Monitoring your use of the Services and communicating with you;
  • Maintaining back-ups of our databases;
  • Sending you notifications, newsletters or other information related to Ålö products; and
  • Developing new products and services;
  • Providing tailored tips and suggestions on, inter alia, how you can optimize the use of your loader;
  • Complying with legal obligations or protecting your vital interests or the vital interests of another natural person; and
  • For any purpose where information has been anonymized.

C. Collection and Use of Information from Children Under the Age of 15

Our Services are not intended for use by persons under the age of 15. Ålö does not knowingly collect information from visitors under the age of 15 and, in the event that we learn that a person under the age of 15 has provided us with personal information, we will delete such personal information.

D. Sharing and Disclosure of Information

We may share or disclose your personal and non-personal information in the following instances:

  • To fulfil a service to you;
  • To affiliates, strategic partners, agents, third party marketers or other unaffiliated parties who are offering products or services that we believe may be of interest to you or who require your personal information for research, administrative and/or internal business purposes;
  • To unaffiliated third party service providers, agents or independent contractors who help us maintain our Services and provide other administrative services to us;
  • To comply with the law or in good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, or act in urgent circumstances to protect the personal safety of our end users;
  • To third parties as part of any corporate reorganization process (or proposed process) including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets;
  • To track and analyse non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties; and
  • To protect against potential fraud, we may verify with third parties the information collected from our Services.

E. Opt-Out

From time to time we communicate with users who subscribe to our Services via the Q-companion mobile application. For example, we may send you information about changes to our products and services, educational material and other disclosures as required by law. Generally, users cannot opt-out of these communications, but they will be primarily informational in nature rather than promotional. However, we provide you the opportunity to opt-out if you do not want to receive other types of communications from us, such as in-app notifications regarding special campaigns and/or offers. You may opt-out of these notifications in the settings menu.

F. International Transfer of Information

If you choose to provide Ålö with personal information, Ålö may transfer that information to its affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from Canadian law, please note that you are transferring your personal information to Canada which does not have the same data protection laws as the EU and may provide more limited recourse mechanisms, including dissimilar or, at times, weaker data protection rights. With knowledge of these risks, by providing your personal information, you consent to:

  • The use of your personal information for the uses identified above in accordance with this Privacy Policy; and
  • The transfer of your personal information to Canada as indicated above.
  • The transfer of your personal information from Canada to the European Union.

G. Information Security

Ålö will use commercially reasonable efforts to safeguard your personal information. However, no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to Ålö is done at your own risk.

If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using our website or mobile application, or by providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of our services. We may post a notice on our website or mobile application if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

H. Accessing Your Personal Information and Privacy Preferences

We provide you with the opportunity to access your personal information to ensure it is correct, accurate, and up-to-date. To access or edit your personal information, please contact us at feedback@myqcompanion.com. We will make reasonable efforts to accommodate your request.

I. Retention and deletion of Personal Data

The personal information that Ålö processes will not be kept for longer than necessary for the purpose for which it was collected. Ålö will retain your personal information for a period of two (2) year after you are no longer registered as a user of our Services. After that it will be deleted from our systems. Notwithstanding this, Ålö may retain your personal information where such retention is necessary for compliance with a legal obligation, to which Ålö is subject.

J. Assignment

In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign and/or transfer the personal and non-personal information collected via the Services to the other party.

K. Changes to This Privacy Policy

We reserve the right to change this Privacy Policy from time to time. When we do, we will also revise the “Effective” date at the top of this Privacy Policy. If we make material changes to how Ålö uses your personal information, we will attempt to obtain your consent before implementing the change by sending a notice to the primary e-mail address specified in your account or by placing a prominent notice on our website or mobile application.

L. Dispute resolution and choice of law

This Privacy Policy has been made in and shall be construed in accordance with the laws of Sweden, without giving effect to any conflict of law principles. Both parties agree that the courts of Sweden shall have non-exclusive jurisdiction to settle any dispute, controversy or claim arising out of, or in connection with, this Privacy Policy, or the breach, termination or invalidity of the Privacy Policy.

Your visit to our website and mobile application is subject to both this Privacy Policy and our Terms of Use, available at www.myqcompanion.com.
